1. Agreement to these Terms

These Terms of Service (“Terms”) govern your access to and use of the website located at bowlinemarinas.com and any related content, features, and services (collectively, the “Site”), operated by Bowline Marinas, LLC (“Bowline Marinas,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site. By using the Site, you represent that you meet this requirement and that any information you provide is accurate and current.

3. Use of the Site

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial informational purposes, subject to these Terms. You agree not to:

  • Use the Site in any way that violates applicable law or regulation;
  • Copy, reproduce, distribute, or create derivative works from the Site’s content except as expressly permitted;
  • Interfere with or disrupt the operation of the Site or the servers or networks used to make it available;
  • Attempt to gain unauthorized access to any portion of the Site or any related systems; or

4. Marina Services

The Site provides general information about our marina, boat storage, fuel, maintenance, and related services. Information on the Site is provided for general informational purposes only and does not constitute a binding offer. Any marina services, slip rentals, storage, or memberships are subject to separate written agreements, applicable rules and regulations, and availability. In the event of a conflict between the Site and a signed services agreement, the signed agreement controls.

5. Intellectual Property

The Site and its content are owned by or licensed to Bowline Marinas and are protected by intellectual property laws. All text, graphics, user interfaces, visual interfaces, photographs, sounds, artwork, computer code, programs, software, products, information, and documentation as well as the design, structure, selection, coordination, expression, and arrangement of any content contained on or available through the Site, unless otherwise indicated, are owned, controlled, or licensed by Bowline Marinas. You may not copy, store, reproduce, transmit, distribute, display, rent, lease, sell, modify, alter, license, sublicense, or commercially exploit the Site, or Bowline Marinas’ name, logo, marks, or any other data or information provided on or through the Site in any manner or use the Site in any manner not expressly permitted by these Terms.

6. User Submissions

If you submit comments, inquiries, or other content through the Site, you grant Bowline Marinas a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with operating and promoting our Services. You are responsible for the content you submit and represent that it does not infringe the rights of any third party or violate any law. We may remove any content at our discretion.

7. Third-Party Links and Services

The Site may contain links to third-party websites and services that we do not control. We provide these links for convenience only and we expressly disclaim any responsibility for the content, products, or practices of any third party. Your use of third-party sites is subject to their terms and privacy policies.

8. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION ON THE SITE IS ACCURATE OR COMPLETE. IN NO EVENT SHALL BOWLINE MARINAS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO THE USE OF, OR ACCESS TO, THE SITE OR THE DELAY OR INABILITY TO USE THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF BOWLINE MARINAS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY. YOU ACKNOWLEDGE AND AGREE THAT YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE SITE IS TO STOP USING THE SITE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BOWLINE MARINAS AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED $1,000.

10. Indemnification

You agree to indemnify and hold harmless Bowline Marinas and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (i) your use of the Site; (ii) your violation of the Terms; (iii) your violation of any third-party rights relating to or arising from your use of the Site; or (iv) your violation of any law or regulation relating to, arising from, or your use of or access to the Site.

11. Term and Termination of Use

These Terms shall take effect immediately upon your access to, or use of, the Site after the Terms are posted and will continue until terminated as set forth herein. Bowline Marinas reserves the right to modify, change, or disable the Site or your use of, or access to, the Site, at any time with or without notice. Bowline Marinas shall not be liable for damages in connection with such terminations, disabling, modifications, or changes.
In addition, Bowline Marinas reserves the right to modify or terminate the Terms at any time in its sole discretion upon reasonable notice to you. You agree that Bowline Marinas may provide reasonable notice of such modifications by posting the new or modified terms (the “Modified Terms”) on the Site and specifying an effective date that is at least 10 days after the date the Modified Terms are initially posted. You agree that if you continue to use the Site without written objection to Bowline Marinas, you shall be considered to have accepted the Modified Terms as of the effective date stated therein. Such Modified Terms shall apply prospectively only. If the Terms are terminated or modified, these Terms shall apply only to pre-termination or pre-modification use, access, actions, or omissions.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Dade County, Florida.

13. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bowline Marinas regarding the Site.
